SS-4 Line 7b: What To Write If You Have No SSN Or ITIN

  • Line 7b: the responsible party's US tax ID, or the foreign-owner entry if they do not have and are ineligible for an SSN or ITIN.

Who is the responsible party?

For most single-owner foreign-owned LLCs, the responsible party is the person who owns or controls the company.

A registered agent is not automatically the responsible party. The registered agent receives official mail; they usually do not control the company.

Why the IRS online EIN tool usually does not work

The online EIN tool expects a responsible party with a valid US tax ID. Many non-US residents without an SSN or ITIN must use Form SS-4 by fax or mail instead.
